Notice of Unemployable Offenses: Ohio Revised Cord (O.R.C.) 9.73 permits public employers to place on their employment applications notice of Ohio and federal laws that disqualify an individual with a particular criminal history from being hired for certain school district positions. Be advised that public schools and educational service centers are prohibited from employing: (1) anyone who has been previously convicted of or pleaded guilty to the offenses listing in O.R.C. 3319.39; (2) anyone in a teaching position who has previously been convicted of or pleaded guilty to any of the offences listed in O.R.C. 3319.39 and O.R.C. 3319.31; and (3) anyone in a pupil transportation position previously convicted of or pleaded guilty to any of the offenses listed in O.R.C. 3319.39 and Ohio Administrative Code 3301-83-23. Additionally, public schools and educational service centers are required by law to conduct criminal records checks for most positions before employing individuals.

Candidate authorizes the school district to conduct an investigation of candidate pursuant to The School Code to determine whether candidate has been convicted of any criminal or drug offenses as set forth in such statute, and, upon request agrees to execute an investigation authorization form as a condition for candidate's employment. The School Code also stipulates that the School District perform a check on the Statewide Sex Offender Database. Candidate may not be employed unless such investigations have been initiated.
